Terms and Conditions
Before using Trip.md, we recommend that you carefully read the terms of use. By using the services of Trip.md, you agree to the Terms of Use.
I. Definitions
The following capitalized terms shall have the meanings set forth below, unless expressly stated otherwise:
Organizing Travel Agency or "OTA" - Trip.md when acting as an organizing agency and selling its own tourist packages;
Intermediary Travel Agency or "ITA" - Trip.md when acting as an intermediary agency and selling tourist packages made available by other partners or in the capacity of organizing agencies;
The Insurer or Axa Assistance - the company Inter Partner Assistance Societe Anonime with registered office in Brussels, Avenue Louise 166 b1, Brussels, 1050, Belgium, a company registered under Belgian law and registered under number 0415.591.055, a company within the Axa Assistance group;
The Airline Ticket - the electronic document based on which the flight is carried out;
Insurance Application - the application for concluding the Insurance Contract, completed by the User on the Site with the data necessary for concluding the Insurance Contract;
Booking Request – the request submitted by the User/Passenger to conclude the Intermediation Contract with Trip.md;
Scheduled Airline - the airline that provides air passenger transport services and is a member of IATA;
Low Cost Airline - an airline that provides air passenger transport services and is not a member of IATA;
Trip.md Consultant – the internal or external agent made available to Trip.md to respond to customer requests;
Consumer - any natural person acting for purposes outside their commercial, industrial/production, artisanal or liberal activity;
Intermediation Contract - Contract concluded between the user (User, Passenger, you) and Trip.md based on these Terms and Conditions;
Insurance Contract – the contract concluded between the Insurer and the User under the GIT, based on which the Insurer undertakes to fulfill the obligation to pay the insurance benefit specified in the GIT in the event of the occurrence of the insured event, and the user undertakes to pay the insurance premium;
Transport Contract – the contract concluded by the User with the airline providing air transport services, which is concluded by the User's acceptance of the General Conditions of Booking and Sale of Airline Tickets of the Tourism Service Providers existing on the Trip.md website.
General Conditions of Booking and Sale of Airline Tickets of Tourism Service Providers – the terms and conditions of airlines and/or other travel service intermediaries acting as Tourism Service Providers.
Tourism Service Provider - the third party that makes available or intermediates the provision of the service/product marketed by Trip.md;
Itinerary or Trip - the route to be followed by the Passenger;
Booking - the confirmation by Trip.md of the conclusion of the Intermediation Contract by sending airline tickets to the User/Passenger;
Site(s) - the platform www.Trip.md or Trip.md offered by Trip.md;
Passenger or Client - the Client who books and/or purchases an airline ticket or another service/product made available by Trip.md;
Partner – the organizing agency that makes tourist packages available to Trip.md;
Total Price – the price of the product or service offered by Trip.md with all taxes and commissions included;
Additional Service – any service purchased from Trip.md or from Tourism Service Providers in connection with airline tickets such as: luggage, seats on the aircraft, sports equipment, compensation/refund requests, without this list being exhaustive;
Terms and Conditions – the rules based on which the Intermediation Contract is concluded;
General Insurance Terms or "GIT" - the general insurance terms and conditions available on the Site, which form an integral part of the Insurance Contract;
Tourist or Traveler – the Client who is party to a tourist package sales contract;
User - the natural person or representative of the legal entity who concludes the Intermediation Contract on behalf of other passengers on the booking;
Voucher - an electronic document (with value indicated in EUR) that allows the User to purchase air transport services offered by Trip.md;
Trip.md or the Agency - the commercial company KIV DIGITAL GROUP S.R.L a Romanian company with registered office in Chisinau, Moldova 31 August 1989 St 64 Tax ID: RO 1020600034075
Cancelled Flight – the situation where the airline does not operate a previously scheduled flight;
Modified Flight – the situation where the airline decides to change the flight schedule or the previously scheduled flight itinerary;
II. Acceptance of Terms and Conditions
2.1. It is important to read these Terms and Conditions carefully before using the Site. These Terms and Conditions apply together with the General Conditions of Booking and Sale of Airline Tickets of Tourism Service Providers, the Privacy Policy and the Cookie Policy on the Site.
2.2. By using this Site you fully agree with these Terms and Conditions. If you do not fully agree with these Terms and Conditions, you may not use this Site in any way or order services or products from Trip.md.
III. Trip.md Services and Products
3.1. Trip.md provides you with the Site which offers the possibility to search and check availability for various tourism services and allows you to make the desired booking.
3.2. Bookings and sales of airline tickets are subject to these Terms and Conditions and the General Conditions of Booking and Sale of Airline Tickets of Tourism Service Providers.
3.3. Trip.md acts as an intermediary between the User and Tourism Service Providers such as: airlines, hotels, car rental companies, based on the User's booking mandate.
3.4. Trip.md assumes no responsibility for the tourism products and services offered by Tourism Service Providers and does not guarantee in any way the accuracy or quality of the products and services reflected on this Site.
3.5. Any booking made online or offline implies acceptance of the Trip.md Terms and Conditions and the rules set out in the contract with the tourist.
3.6. Trip.md also acts as an intermediary for insurance companies, therefore Trip.md is not a party to insurance contracts.
IV. Information Published on the Site
4.1. Trip.md provides general information through the Site for consultative purposes. Please carefully review all information on the Site and note that this information may be modified/updated at any time.
4.2. Trip.md does not guarantee the accuracy of information on the Site, but will make the necessary efforts to correct errors as soon as they are brought to our attention.
4.3. Trip.md assumes no responsibility for the tourism products and/or services offered by Tourism Service Providers.
V. Publication of Information on the Site
5.1. Trip.md makes every effort to publish relevant information in Romanian on the Romanian version of the Site, however some information may be provided in English. If there are any uncertainties, please contact us at [email protected].
VI. Tourism Service Provider Conditions
6.1. Any Booking Request made on the Site will be considered as your intention to purchase a certain tourism product or service from Trip.md. The Intermediation Contract will be considered concluded and will enter into force only after full payment has been made.
6.2. All services published on the Site are available subject to their availability from Tourism Service Providers.
6.3. Please carefully read the specific conditions applicable to special offers and contact Trip.md consultants for complete details.
6.4. You are directly responsible for complying with the conditions imposed by the Tourism Service Provider regarding boarding times, completing the necessary formalities and presenting the required travel documents. The minimum recommended boarding time is 120 min. for European flights, 180 min. for non-European flights, and 90 min. for domestic Romanian flights.
VII. General and Specific Conditions Applicable to Airline Ticket Sales
Airline Ticket Booking
7.1. Airline ticket booking can be done online on the Site. Any booking made on the Site is subject to acceptance of both these Terms and Conditions and the special conditions imposed by the Tourism Service Provider.
7.2. Upon submitting the Booking Request to Trip.md, you authorize us to make the booking with Tourism Service Providers on your behalf. Bookings will be made subject to availability from the Tourism Service Provider.
7.3. For certain flights, bookings cannot be confirmed on the Site, therefore your request will consist of a booking request that will be subsequently processed by Trip.md consultants.
7.4. Please consult the travel conditions for your destination and transit countries, as well as the safety measures taken by the airline. Trip.md is exempted from any liability in case of non-compliance with travel conditions by passengers.
Payment Methods
7.5. Payment is required before ticket issuance. Trip.md provides a variety of payment methods. The Intermediation Contract is considered concluded only after payment of the Total Price.
7.6. The fare communicated on the site may include all fees charged by Trip.md or Tourism Service Providers, or these fees may be displayed separately.
7.7. For scheduled airline ticket bookings, payment must be made within a certain time frame. If payment is not made within the communicated period, Trip.md reserves the right to cancel the tickets automatically.
7.8. For low cost airline tickets, bookings cannot be made without payment being registered in Trip.md accounts.
7.9. Between the time of booking and the time of payment, fare changes may occur or seats may no longer be available. Trip.md will notify you and communicate the updated fare.
7.10. We do not accept payment methods other than those presented on the Site. Trip.md does not store card data.
7.11. Prices that Users see on the Site may be personalized based on an automated decision-making process.
7.12. Trip.md or the Tourism Service Provider assumes no obligation to issue tickets in case of non-payment.
7.13. Payment can be made with the major credit cards recognized and presented on the Site.
7.14. Trip.md and/or the Tourism Service Provider, when acting as intermediary, is mandated by the User to make payment operations on behalf of the User.
7.15. If requested by your credit card issuer, Trip.md reserves the right to send tickets to your address declared at the time of card issuance.
7.16. We reserve the right to perform random verifications to minimize credit card fraud.
7.17. All fares, taxes and/or commissions may fluctuate due to exchange rate changes and/or fees imposed by Tourism Service Providers.

Cancellations/Modifications
7.19. In the event of modification/cancellation of a booking, Trip.md reserves the right to apply certain administrative fees. If any flight is cancelled by the airline, Trip.md will charge the User an additional fee of 15 EUR/flight/pax for refund processing.
7.20. Only the User has the right to make changes to the Booking. Voluntary cancellation is irreversible. Flights on the booking must be used in the order they were booked.
7.21. The airline may cancel, delay or modify the flight schedule without prior notice. You must send a response regarding the options presented within 48 hours before the planned flight date.
7.22. If your flight is cancelled, delayed or you are denied boarding, we can assist you in compensation claims under EU Regulation 261/2004.
ADDITIONAL SERVICES
Luggage
7.23. Each airline has its own luggage transport rules. It is your responsibility to check for any changes in the airline's luggage policy before traveling.
7.24. Some scheduled airlines include hand and/or hold luggage in the fare. Low cost airlines charge luggage separately.
7.25. Each airline has different rules regarding dimensions and weight of hand or hold luggage.
7.26. Each passenger must check their own luggage and what can be taken in hand luggage and checked luggage respectively.
Online and Airport Check-in
7.27. Trip.md offers a paid online check-in service during or after ticket purchase.
7.28. Online check-in is optional. Fees charged by the airline for airport check-in cannot be attributed to Trip.md if the service was not purchased through us.
7.29. If you purchased online check-in from Trip.md, you will receive all necessary instructions by email.
7.30. Check-in data must be completed within the deadline indicated in the email from Trip.md.
7.31. It is the passengers' responsibility to provide correct information for the online check-in process.
7.32. Boarding passes will be sent 3-6 hours before each departure.
7.33. For multi-segment flights, boarding passes will be sent for each flight segment.
7.34. If online check-in is not offered by the airline, Trip.md will inform you accordingly.
7.35. After receiving boarding passes, make sure the data is correct.
7.36. When completing check-in data, you must declare that you have read and understood the list of prohibited items.
7.37. During online check-in, the airline assigns seats randomly if you have not purchased preferred seats.
7.38. If traveling with hold luggage or with travel documents issued outside the EU, you must present yourself at the check-in desk.
7.39. For combined flights, please complete check-in for each flight segment before the first flight.
7.40. If Trip.md cannot complete the online check-in, it will refund the 5 EUR/pax fee pro rata for uncompleted segments.
Seat Reservations
7.41. Seat reservations for flights are made using international computerized reservation systems.
7.42. Preferred seats can be purchased for an additional cost charged by Tourism Service Providers.
7.43. All conditions, rules and restrictions applicable to an airline ticket are those dictated by the airline.
7.44. If the preferred seats selected are no longer available, Trip.md has an implicit mandate to modify them by up to +/- 3 rows.
7.45. The airline may change the aircraft type at any time, in which case Trip.md cannot guarantee that initially selected seats can be maintained.
SMS Service
7.46. If you purchase the SMS notification service:
- you will receive text messages regarding your specific booking;
- you should use the SMS service without violating third-party rights.
7.47. We will send SMS notifications regarding: booking confirmation, online check-in reminders, and flight modification or cancellation notifications.
7.48. SMS notifications will be sent to the provided mobile phone number, at the frequency and timing decided by Trip.md.
7.49. Trip.md is exempt from liability if the User did not provide a valid mobile phone number.
Airline Ticket Issuance
7.50. Ticket issuance will be done according to the conditions imposed by each airline.
7.51. Trip.md reserves the right to present various Package Tickets on the site, which may include different services at a similar or cheaper price.
7.52. All services included in each Package Ticket will be provided in the presentation on the Site. Trip.md reserves the right to modify or remove services included in Package Tickets.
7.53. Trip.md may offer the User the option to upgrade to a superior Package Ticket type.
7.54. Each Package Ticket contains a certain type of customer assistance.
7.55. Trip.md offers the option to upgrade communication channels to phone support.
7.56. The price for the superior communication channel will be set for each booking.
7.57. Package Tickets are not available for post-sale purchase.
7.58. The specific terms for Online Check-in, Trip.md Flex, Trip.md Fast Refund also apply to Package Tickets.
7.59. Before ticket payment, Trip.md may present various upgrade alternatives.
7.60. All fees paid for Package Tickets are non-refundable.
7.61. The User can pay in RON (Lei) or EUR, at the exchange rate provided by fixer.io on the payment day, plus a 4% currency risk commission.
7.62. When using a Voucher issued by Trip.md, the User must pay a minimum difference of 1 EUR.
7.63. Travel documents for the booking can be sent by electronic mail.
VIII. Airline Ticket Prices
8.1. Airline ticket prices are set by airlines and may vary depending on the time of purchase, the airline, the flight class, the destination and other criteria.
8.2. In accordance with airline regulations, the ticket price may be modified by the airline even after booking but before ticket issuance, without Trip.md assuming any responsibility.
8.3. The price displayed on the Site or communicated by Trip.md consultants includes the Trip.md service fee and may include airport taxes and other airline fees.
8.4. In case of a pricing error, Trip.md reserves the right to cancel bookings made at an incorrect fare and to fully refund the amount paid.
IX. Travel Cancellation and Modification Conditions
9.1. Travel cancellation/modification conditions are dictated by each airline and are presented at the time of booking, in the airline regulations and/or in the booking confirmation email.
9.2. Trip.md, as an intermediary, cannot modify the cancellation rules imposed by airlines.
9.3. For non-refundable airline tickets, the User is not entitled to a refund of the ticket fare, however in certain cases, airport taxes may be recoverable, after deduction of Trip.md service fees.
9.4. Tickets purchased through Trip.md can only be cancelled or modified through Trip.md. Any modification made directly with the airline, without Trip.md's consent, may result in loss of rights to ancillary services purchased from Trip.md.
9.5. If the tourist modifies or cancels the trip, airline and Trip.md fees apply according to the conditions presented at the time of booking.
9.6. If the flight is cancelled by the airline, Trip.md will notify you and offer available alternatives.
Visas, Vaccines and Special Assistance
9.7. It is the exclusive responsibility of the Passenger to inform themselves about necessary travel documents (passport, visa, vaccines) and obtain them in due time.
9.8. Trip.md assumes no responsibility for denial of boarding or entry into a country caused by lack of necessary travel documents.
9.9. If you need special assistance (persons with disabilities, unaccompanied minors, etc.), please inform us before making the booking.
Combined Flights
9.10. Trip.md may offer combined flights that include two or more flights by one or more airlines. Each flight is treated as a separate service, with a separate PNR. Airlines do not cooperate in organizing such itineraries.
9.11. For combined flights, if one flight is cancelled or modified, the other flights in the itinerary are not automatically affected. The User must check the status of each flight individually.
Promotional Campaigns
9.12. Trip.md reserves the right to run promotional campaigns with price reductions. These campaigns may have special conditions.
X. Specific Conditions Applicable to Hotel Bookings and Tourist Packages
Hotel Bookings
10.1. Trip.md provides its clients with the possibility to book hotel rooms. Hotel information is sourced from our providers and may differ from other sites or at the hotel reception.
10.2. Trip.md does not assume responsibility for differences between facilities presented on the Site and those actually offered by the hotel.
10.3. Room types:
- Double room – contains a double bed for 2 persons;
- Twin room – contains 2 single beds;
- Double/twin single use – contains a double bed for one person;
- Triple room – contains 3 beds or a double bed and an extra bed;
- Quadruple room – contains either 2 double beds, 4 separate beds, or 1 double bed and 2 extra beds;
- Twin/double plus child – contains either 2 separate beds or a double bed plus 1 extra bed for a child.
10.4. Children up to 2 years are considered infants and a cot requires confirmation from the hotel.
10.5. Room allocation to tourists is done by the hotel.
10.6. If the booking cannot be honored, the hotel is obliged to offer accommodation in another hotel unit of the same or higher category.
10.7. Booking payments must be made in accordance with the terms specified at the time of booking.
10.8. Depending on the hotel's terms, full or partial payment may be required at the time of booking, and payment will be made to the account of Trip.md, the hotel or its representative.
10.9. Hotel payments are made in accordance with the above paragraph.
Trip.md Hotel Discount Campaigns
10.10. Trip.md reserves the right to run multiple hotel discount campaigns.
10.11. Clients who book only accommodation from Trip.md may benefit from discounts at a range of hotels.
Booking Cancellation and Modification Conditions
10.12. Cancellation can be made directly by the tourist or the cancellation request must be made in writing to Trip.md.
10.13. The cancellation policy applied to each booking depends on the type of service, the Tourism Service Provider and the travel date.
10.14. Attention! Please carefully read the cancellation terms and conditions before confirming the booking.
XI. Comment Collection
11.1. Trip.md may collect your opinion about hotels, destinations or services offered.
11.2. Clients give their consent for the publication of comments on the Site and their offline use by Trip.md consultants.
11.3. Trip.md reserves the right to refuse certain comments, especially those with vulgar language. Comments provided by clients become the property of Trip.md.
XII. Special Terms and Conditions Applicable to the Purchase of Trip.md Flex
12.1. The main characteristics of Trip.md Flex are detailed in clauses 12.1-12.9:
What is Trip.md Flex?
12.2. Trip.md Flex allows you to voluntarily cancel your Booking for any reason up to 24 hours before the first departure and receive a partial refund ("Refund") of the Price:
- Refund: 90% of the trip Price (capped at 7,000 EUR/booking);
- No reason or proof required;
- One-click cancellation;
- Cash transfer within 3 business days.
How does Trip.md Flex work?
12.3. Trip.md Flex applies when you purchase an airline ticket and add it to your Booking Request, and subsequently choose to voluntarily cancel the Booking.
12.4. The User/Passenger can cancel the Booking using the request form at www.Trip.md/cancel at least 24 hours before the first flight departure.
12.5. Trip.md does not request reasons or proof for voluntary cancellation.
12.6. Trip.md will process the refund to your bank account within 3 business days.
How much money do I get back if I purchased Trip.md Flex?
12.7. You will receive 90% of the Price. The amount is capped at 7,000 EUR/booking.
How quickly do I get my money back?
12.8. You will receive your money back within 3 business days.
Is the cost of Trip.md Flex refundable?
12.9. The cost of Trip.md Flex is non-refundable, except if the Booking Request is cancelled by us or before the electronic ticket is issued.
WHAT DOES Trip.md OFFER THROUGH Trip.md FLEX?
12.10. Trip.md provides you with the Site to search and check airline ticket availability. Through Trip.md Flex, Trip.md offers you the possibility to voluntarily cancel your trip without reason.
12.11. Trip.md Flex allows you to voluntarily cancel your booking and receive a partial refund in cases where the Price is non-refundable or the refundable amount is less than the Refund.
12.12. Trip.md offers Trip.md Flex which allows you either:
a. to voluntarily cancel your Booking at least 24 hours before the first flight departure and receive 90% of the Price.
b. to reschedule the flight, if such an option is available with the airline, without paying Trip.md service fees.
12.13. Cancellation/rescheduling will apply to all flight segments and all passengers in the Booking.
12.14. Under Trip.md Flex, we will offer the following alternatives from which you can select only one, and only once:
(i) Cash refund for a flexible cancellation up to 24 hours before the first departure, or
(ii) Rescheduling Assistance.
CASH REFUND
12.14.1. If you wish to voluntarily cancel up to 24 hours before the first departure, we will refund you 90% of the Price in cash.
12.14.2. We will refund using the same payment method used for the Booking Request, within a maximum of 3 business days.
12.14.3. If you paid using multiple payment methods, the Refund will be made in cash to your card.
ASSISTANCE
12.14.4. If you wish to cancel but still want to travel, we can offer rescheduling assistance.
12.14.5. In addition, Trip.md offers professional support and special assistance for your trips.
WHEN CAN Trip.md FLEX BE PURCHASED?
12.15. You can purchase Trip.md Flex only when initially placing the Booking Request.
WHEN DOES Trip.md FLEX APPLY?
12.16. Trip.md Flex applies if added and paid within the Booking Request and you subsequently choose to cancel your Booking or make a new booking.
12.17. Exceptionally, Trip.md Flex also applies when the flight consists of segments sold by different Providers and at least one segment is cancelled by the Provider.
12.18. Trip.md Flex will be offered at Trip.md's discretion.
HOW DOES Trip.md FLEX WORK?
12.19-12.25. Trip.md Flex applies when you purchase an airline ticket and subsequently choose to cancel or make a new booking. The voluntary cancellation must refer to all passengers and all flight segments. Trip.md Flex is offered in exchange for an additional fee presented on the Site at the time of purchase.
WHEN DOES Trip.md FLEX NOT APPLY?
12.26. Trip.md Flex does not apply in case of involuntary cancellations:
a. Flight Cancelled or Modified by the Airline before Refund processing; b. Airline that suspends or ceases activity; c. Travel restriction; d. Denial of boarding; e. No-show; f. Cancellation of the Booking Request by Trip.md.
12.27. Trip.md Flex does not cover additional travel expenses or other compensations.
Trip.md FLEX LIMITATIONS
12.28-12.30. Solutions are offered subject to cumulative conditions. Trip.md Flex is automatically cancelled/invalidated if the User modifies details directly with airlines, the cancellation was made directly with the airline, or the cancellation was not made within 24 hours before the first departure.
RIGHTS TRANSFER CONDITIONS
12.31-12.41. By purchasing Trip.md Flex, the User transfers to Trip.md the rights to request refunds from the airline. The Trip.md Flex Terms and Conditions are supplemented by the General Terms and Conditions of Trip.md, and in case of conflict, Trip.md Flex conditions prevail.
XIII. Special Terms and Conditions Applicable to the FAST REFUND Service
WHAT IS THE Trip.md FAST REFUND ANCILLARY SERVICE?
13.1. Trip.md provides you with the site that offers the possibility to search and check availability for purchasing airline tickets, as well as ancillary services. Trip.md offers you the FAST REFUND ancillary service which is available for eligible flights.
13.2. Through the FAST REFUND service, Trip.md offers you assistance if your booking is affected by:
(i) cancellation of certain or all flight segments in the itinerary ("Cancelled Flight") or
(ii) modification of the flight schedule or itinerary ("Modified Flight") by the airline, both situations referred to as "Event".
13.3. In case of an Event, Trip.md offers you assistance in finding an alternative or refunding the cost of affected flight segments as a Voucher or cash.
13.4. With FAST REFUND, your money doesn't remain blocked with the airline and you can quickly receive a refund.
WHEN IS THE FAST REFUND SERVICE APPLICABLE?
13.5. The FAST REFUND service is applicable when your flight purchased through Trip.md is a Cancelled Flight or a Modified Flight for reasons beyond Trip.md's control.
13.6. FAST REFUND is applicable only in situations where the airline has a legal obligation under Regulation (EC) No. 261/2004 to offer alternatives and/or refund the ticket cost.
13.7. Trip.md will notify you as soon as possible about the Event and offer assistance, or refund you within a maximum of 3 business days, as a Voucher or cash.
13.8. The prerequisite for FAST REFUND is the assignment to Trip.md of the rights to claim against the Cancelled/Modified Flight.
13.9. If you are informed directly by the airline about an Event, you must inform us without undue delay.
WHAT DOES Trip.md OFFER THROUGH FAST REFUND?
13.10. Under the FAST REFUND service, we will offer you the following solutions from which you can select only one:
FREE ASSISTANCE
13.10.1. If you accept the free alternative offered by the airline, we offer assistance for issuing the ticket on the new flight, at no additional cost.
VOUCHER OR CASH REFUND
13.10.2. If you refuse the alternatives offered by airlines, Trip.md provides you with the following alternatives:
a. Trip.md VOUCHER REFUND: Trip.md will issue a Voucher with the following characteristics:
- with value equivalent to the amount confirmed by the airline;
- with a validity of 24 months;
- intended for use through Trip.md;
- which can be used for multiple bookings.
13.10.3. The Voucher can only be used through Trip.md by entering the code during the booking process.
13.10.4. The Voucher will be provided within 24-48 hours, but no later than 3 business days.
13.10.5. The Voucher is non-refundable. It can be partially or fully transferred to a third party.
13.10.6. Each Voucher has a unique code that must be protected.
13.10.7. Unused amounts will not be refunded when the Voucher expires.
13.10.8. When using the Voucher, the User will be required to pay 1 EUR by card for validation.
13.10.9. The Voucher is issued in EUR currency.
13.10.10. Trip.md will not be liable for use of the Voucher contrary to its purpose.
13.10.11. Trip.md will not be liable in case of loss of the unique Voucher code.
b. CASH REFUND: If you do not wish to continue your trip, we can refund you in cash the equivalent value confirmed by the airline.
13.10.12. The amount will be refunded using the same payment method, within a maximum of 3 business days.
13.10.13. If you paid with multiple methods, the refund will be provided through both payment methods proportionally.
FAST REFUND SERVICE LIMITATIONS
13.11. Solutions are offered subject to cumulative conditions: tickets are purchased through Trip.md and the Fast Refund service is purchased at the time of ticket purchase.
13.12. If you make changes directly with the airline without our approval, the FAST REFUND service is void.
13.13. The cash refund option will no longer be available if we do not receive a response at least 48 hours before the planned flight date.
13.14. By purchasing FAST REFUND, you assign to Trip.md the right to claim refunds from the airline.
WHEN IS THE FAST REFUND SERVICE NOT APPLICABLE?
13.15. The FAST REFUND service is not applicable in the following situations:
- The User voluntarily cancelled the Trip;
- The User is denied boarding;
- The User did not check flight status before departure;
- The User modified details directly with airlines;
- The flight is affected by airline insolvency/bankruptcy;
- The flight is affected by a mass cancellation (30% or more of flights);
- The airline's refund policy was modified after purchase;
- In all cases where FAST REFUND becomes inapplicable, Trip.md will refund the fee paid.
WHEN CAN THE FAST REFUND SERVICE BE PURCHASED?
13.16. The FAST REFUND service can only be purchased at the time of airline ticket purchase.
WHAT IS THE COST OF THE FAST REFUND SERVICE?
13.17. The FAST REFUND service is offered in exchange for an additional fee set as a percentage, between 10%-20% of the ticket purchase value.
WHAT DOES THE FAST REFUND SERVICE NOT COVER?
13.18. The FAST REFUND service does not cover any additional expenses related to the trip (medical insurance, Trip.md Refundable, etc.).
UNDER WHAT CONDITIONS IS THE TRANSFER OF RIGHTS MADE?
13.19. By purchasing FAST REFUND, you accept these Terms and Conditions and assign us the right to initiate and obtain refunds from the airline.
13.20. The User/Passengers declare that they have not and will not request ticket price restitution from other entities and authorize Trip.md to take any necessary steps.
13.21. Acceptance of any alternative will be considered consent and acceptance of these Terms and Conditions.
13.22-13.27. The User transfers to Trip.md all claims rights against the airline and insurer. Cost reimbursement must be made within 14 days.
RELATIONSHIP BETWEEN FAST REFUND TERMS AND Trip.md GENERAL TERMS AND CONDITIONS
13.28. Capitalized terms not defined in this section shall have the meaning from the General Terms and Conditions of Trip.md.
13.29. These Terms and Conditions are supplemented by the General Terms and Conditions of Trip.md, and in case of contradiction, the FAST REFUND terms prevail.
XIV. Special Terms and Conditions Applicable to the Purchase of Trip.md TRIP PROTECT
WHAT IS TRIP PROTECT AND WHEN DOES IT APPLY?
14.1. Trip.md offers through the Site the possibility to search and purchase airline tickets for direct flights and combined flights ("Trip").
14.2. Trip.md may offer for all flight types the Trip.md TRIP PROTECT service ("Guarantee").
14.3. The Guarantee applies when you purchase a ticket and add the service to the Booking Request, and subsequently the airline cancels the flight or modifies the itinerary ("Event"), so that passengers can no longer depart/arrive on time or catch connections.
14.4. The Guarantee may apply only in cases where the flight is affected by Events caused by factors in the ordinary course of air transport activity.
WHEN DOES Trip.md TRIP PROTECT NOT APPLY?
14.5. The Guarantee does not apply in the following situations:
- (i) Schedule change of less than 5 hours (except when affecting connections);
- (ii) Voluntary cancellation of the Trip;
- (iii) Denial of boarding;
- (iv) Failure to check flight status;
- (v) Modification of details directly with airlines;
- (vi) Airline insolvency/bankruptcy;
- (vii) Mass cancellation/modification (20% or more of flights);
- (viii) Extraordinary circumstances (political instability, adverse weather, wars, epidemics, pandemics, terrorist attacks, strikes, etc.).
WHEN CAN Trip.md TRIP PROTECT BE PURCHASED?
14.6. The Guarantee can only be purchased at the time of airline ticket purchase.
WHAT DOES Trip.md OFFER UNDER THE GUARANTEE?
14.7. The Guarantee offers you one of the following alternatives:
- (i) help you reach your final destination, or
- (ii) refund the value of the airline ticket for the affected flight.
14.8. The Guarantee applies only in case of an Event notified before the scheduled departure.
14.9. We will offer you the following solutions:
14.9.1. Alternative transport to your destination:
- (i) with the same airline; or
- (ii) with another airline; or
- (iii) with another means of transport.
Trip.md will cover the cost of alternative transport up to the maximum limit specified.
14.9.1.1. In certain situations, Trip.md may offer one-night accommodation, limited to 150 EUR/booking.
14.9.1.2. We will need a reasonable time to process alternative bookings.
14.9.1.3. If we cannot purchase alternative flights online, you may purchase tickets on your own and we can refund the price.
14.9.1.4. The cost of alternatives cannot exceed double the price of the tickets for the affected segments.
14.9.2. Refund of airline ticket value
14.9.2.1. If you do not agree with the proposed alternatives, you can request only the refund of the affected flight segments.
14.9.3. The Trip.md Guarantee is offered in exchange for a dynamic price presented on the Site at the time of purchase.
UNDER WHAT CONDITIONS IS THE TRANSFER OF RIGHTS MADE?
14.9.4-14.9.14. By purchasing the Guarantee, you accept these Terms and Conditions and assign to Trip.md the right to initiate and obtain refunds from the airline. The User transfers all claims rights to Trip.md. The Guarantee Terms and Conditions are supplemented by the General Terms and Conditions of Trip.md, and in case of contradiction, the Guarantee conditions prevail.
XV. Other General Terms and Conditions Applied to Trip.md Services
15.1. In accordance with GO 34/2014, Trip.md does not have a product return policy, and any refunds are made only in accordance with these Terms and Conditions.
15.2. Before finalizing a booking request, the Client must agree to these Terms and Conditions.
XVI. Complaints
16.1. Any problem arising during the tourist's stay must be urgently communicated to Trip.md in order to resolve it in a timely manner.
16.2. The Client has the right to file a complaint using all means of communication made available by Trip.md. Please send your messages to [email protected].
16.3. Any disputes between consumers, Site users and Trip.md can be resolved amicably through the alternative mechanism (ADR) of the judicial system. Applicable legislation can be consulted here. Otherwise, the parties agree to address the competent courts in Bucharest.
XVII. Site Usage
Trip.md is not responsible for the User's ability to access or use the Site nor for failures caused by lack of such abilities. Trip.md does not guarantee that the Site cannot be affected by viruses or other actions that may cause malfunctions or other losses.
XVIII. User Obligations
18.1. If you use the Site, you agree to comply with the following obligations:
- financial responsibility for all transactions made on your behalf;
- the legal capacity required to be contractually bound, specifically being over 18 years of age;
- guaranteeing the accuracy of data provided about you or your family members;
- not using the Site for speculative purposes, generating false or fraudulent bookings;
- not transmitting political, pornographic, racist or other materials that violate the law;
- the obligation not to alter, copy, transmit, distribute, sell, display, license or reproduce the content of the Site.
18.2. Trip.md does not provide travel document preparation services (passports, visas, required vaccines, etc.). It is the User's responsibility to ensure they travel in compliance with the imposed conditions.
XIX. Prohibition of Site Access
Trip.md reserves the right to prohibit your access to the Site at any time without prior notice.
XX. Trip.md Responsibility
20.1. Trip.md is not responsible for indirect losses suffered by you as a result of accepting these Terms and Conditions.
20.2. Trip.md is not responsible for direct and/or indirect losses suffered by the User caused by possible fare differences, lack of availability, or any other incorrect information communicated by airlines and/or hotels.
20.3. Trip.md reserves the right not to provide tourism services whose fares have been displayed erroneously.
20.4. Trip.md is responsible only for direct losses whose value does not exceed the total fare of the tourism services purchased.
20.5. Trip.md cannot guarantee uninterrupted operation of the Site.
XXI. Links to Other Sites
21.1. The Site may contain links to other external web pages. Trip.md has no control over or association with these web pages.
21.2. The content of these external web pages does not reflect the products, services or information provided by Trip.md.
XXII. Force Majeure, Fortuitous Event or Insolvency of the Tourism Service Provider
22.1. Trip.md is not responsible in the event of Force Majeure/Fortuitous Events or in case of insolvency/bankruptcy of the Tourism Service Provider.
22.2. Force majeure events include, but are not limited to: acts of force majeure, government orders, state of emergency, state of alert, travel restrictions, political instability, fires, floods, accidents, storms, volcanic eruptions, epidemics, pandemics, strikes, terrorist attacks, earthquakes and all other unforeseen events.
22.3. Fortuitous Events include any discretionary decision by the Tourism Service Provider causing significant disruption in air transport activity.
22.4. Package Tickets offered by Trip.md are not subject to GO 2/2018.
XXIII. Site Modifications
Trip.md may modify the design or content of the Site, including the availability of Tourism Service Providers, the database, and other Site characteristics.
XXIV. Copyright and Registered Trademark
24.1. Copyright, property rights and Site content are owned by Trip.md or its affiliates.
24.2. The name Trip.md, as well as other trademarks, logos or graphic/figurative elements contained on the Site are registered trademarks of Trip.md or its affiliates.

XXV. Privacy Policy
25.1. Trip.md strives to protect the privacy and image rights of Site users as much as possible.
25.2. When you register on the Site, Trip.md will process personal information in accordance with the Privacy Policy of Trip.md.

26.1. The cookie policy on the Site explains what cookies are and how we use them on our Site.

All fares presented on the site include VAT according to the margin regime applicable to travel agencies.
XXVII. Security Policy
Trip.md uses secure technology to protect your personal information and financial transactions. Trip.md uses Secure Socket Layer (SSL) technology that ensures enhanced security for online purchasing processes.
XXVIII. Modifications to the Terms and Conditions
28.1. Trip.md reserves the right to modify or update the Terms and Conditions at any time, without prior notice. Continued use of the Site after publication of modifications will constitute your acceptance.
28.2. These Terms and Conditions represent the Contract between the User and Trip.md, except in cases where:
(i) special legislation requires the conclusion of other types of contracts, or
(ii) Trip.md negotiates other contractual conditions with contractual partners.
XXIX. Applicable Law
29.1. These Terms and Conditions are governed by the laws of Romania.
29.2. If amicable resolution of disputes is not possible, the User may address the competent courts in Bucharest, in which case the Romanian language version of the Terms and Conditions shall prevail.
